HOUSE CONGRESSIONAL RESOLUTION 45

"END TO TRADE BARRIERS"

One of our attorneys - Steve Baker, President of Steven W. Baker and Associates in San Francisco, provided us the following excerpt from the American Association of Exporters & Importers’ (A.A.E.I.) International Trade Alert, to include the text of H. Con. Res. 45.

Representatives Jim Kolbe (R-AZ) and Steny Hoyer (D-MD) are chief sponsors of H. Con. Res. 45, which calls for an end to the trade barriers on lumber between the U.S. and Canada. The 60 co-sponsors of the resolution believe that the SLA has increased price volatility in lumber markets; restricted the amount of imports from Canada and has had a negative impact on housing affordability - making it a bad deal for U.S. home buyers and home owners. The purpose of H. Con. Res. 45 is to ensure a competitive North American market for softwood lumber, to ensure free trade regarding softwood lumber between the U.S. and Canada, and to ensure that the needs of U.S. consumers are addressed in any trade discussions regarding softwood lumber.

Some of you might recall my pointing out several times during past CVD investigations a provision allowing that even if subsidy and injury findings are determined, if the result of imposing a countervailing duty is determined detrimental to the U.S. public, such findings can be set aside. This provision, to our knowledge, has never been seriously pursued. Most likely because we did not have the U.S. support necessary to carry it through. Now, it would appear that we might have just that support. And, instead of reserving it for the appeal process, we feel it should be brought forth now to provide the opposition with yet another reason to reconsider their chances of ultimate success.
